Appointment of Chief Justice of the High Court

  • Context: The Supreme Court Collegium has decided to transfer the judge who will be appointed as the Chief Justice of the High Court two months in advance.
    • The current Chief Justice of the Madras High Court, M.M. Srivastava, will retire on March 5.
  • The Supreme Court Collegium has recommended the appointment of Sushrut Arvind Dharmadhikari (from Madhya Pradesh) as the new Chief Justice.
    • The judge who will take oath as the Chief Justice of the High Court will be transferred to the High Court two months in advance. This will enable him to know the environment and situation of the concerned High Court and work better before the vacancy occurs there.
  • The Supreme Court Collegium has taken this policy decision to strengthen the administration and quality of justice.

Collegium

  • The Second Judges Case (1993) established the Collegium system for judicial appointments in India.
  • The Collegium is a body for the appointment and transfer of judges in the Supreme Court and High Courts.

Appointment of High Court Judges

  • Article 217 of the Constitution: The President appoints a judge of a High Court in consultation with the Chief Justice of India (CJI) and the Governor of the state.
  • While appointing a judge other than the Chief Justice, the Chief Justice of the High Court is consulted.
