Current Facts Anti-Defection Law Tenth Schedule of the Indian Constitution (Anti-Defection Law): Explains the disqualification of Members of Parliament (MPs) and Members of Legislative Assemblies (MLAs) due to changing political parties. A member may be disqualified in the following circumstances When they voluntarily give up their membership in their political party. When they vote or abstain from voting contrary to the party's direction (whip) without prior permission. When an independent member joins any political party after the election. When a nominated member joins any political party after six months from the date of taking office. Exemptions If at least two-thirds of the members agree to merge with another party, they will not be disqualified. To maintain neutrality, the Speaker or Chairperson may resign from their party membership, and they will not be disqualified if they rejoin after their term ends.
